Minutes of the Municipal Council Meeting
Meeting of 1er March 2019
On March 1st, at nineteen o'clock in the evening of the year two thousand and nineteen, the Municipal Council, duly convened, met in public session under the chairmanship of Monsieur Claude FERCHAL, Mayor.

Adoption of the minutes of the previous meeting
The minutes of the previous meeting, sent in advance to each member of the Municipal Council, were adopted unanimously, there being no observations.
Communications from the Mayor
- Bathing water quality
Monsieur le Maire presents the annual report for the 2018 season on bathing water quality in Haute Normandie. At the end of the season, the ranking is based on the results of the last 4 years. Sainte Marguerite Sur Mer beach is rated as GOOD QUALITY. This report can be consulted at the town hall.
Withdrawal of the Local Urban Plan (PLU) deliberation dated September 28, 2018
Monsieur le Maire explains to the Assembly that a letter RAR was received in Mairie from the Sous-Préfecture dated November 16, 2018 concerning the deliberation of September 28 approving the local urban plan. The approved PLU is irregular with regard to the provisions of articles L121-1 et seq. of the Code de l'Urbanisme resulting from the loi littoral of January 3, 1986.
The various irregular points are detailed below:
- Sainte Marguerite Plage UC sector:
- In the presentation report, the classification of this sector as a "hamlet" (page 197) should be clarified and strengthened, as it is inconsistent with the classification of this hamlet as a "village".
- The UB sectors of diffuse hamlets:
- Bas de Blancmesnil has been classified as a UB sector, authorizing new construction. Considering that it constitutes a diffuse urbanization far removed from the village, new constructions cannot be authorized even in densification of the existing building. In accordance with the French coastal law, it should be reinstated in zone A, or possibly NA.
- Le Haut de Blancmesnil: maintain UB zoning, excluding part of the parcels to the north (383, 384, 385 and 386), which are to be returned to zone NA, and part to the east of parcel C193, which is to be incorporated into zone A.
- Parcel ZA n° 40
- This 4,200 m² plot of land, on which reserved site no. 3 has been set up, must be removed, as it is irregular in terms of the French coastal law.
- The UC urban classification of parcel ZA no. 40 can be maintained. The written regulations for this zone need to be reworked, authorizing the housing typology with a sub-category of dwellings, but restricting building possibilities (ground surface area limited to 30/40 m², maximum height of 3 m/3.50 m to the eaves) and managing the few existing buildings (measured extension of the order of 10/15 % maximum).
The commune had until January 16, 2019 to acknowledge the letter to Monsieur le Sous-Préfet. The Sous-Préfecture acknowledged receipt on January 7, 2019. We have two months from the date of receipt, i.e. March 7, to withdraw the deliberation.
The Municipal Council, having deliberated, unanimously :
- DECIDES to withdraw the deliberation dated September 28, 2018 concerning the approval of the Local Urban Plan (PLU)
Plan Local d'Urbanisme
The Mayor explains that the EUCLYD firm has modified the PLU in accordance with the instructions of the French government.
Following these modification requests, the Mayor received a letter from Mr and Mrs BERTRAND protesting against this zoning modification on their property. Monsieur le Maire requested a meeting with Monsieur Le Sous-Préfet. This took place on Friday 1er February 2019 in the presence of the French government.
Our proposal to review the constructability of part of parcel C240 was accepted, but the plan to rezone Bas de Blancmesnil as close as possible to the built-up area to UB was not, and its classification as an NA zone was confirmed.
Subsequently, the Mayor received Mr and Mrs BERTRAND and their counsel, Maître Axelle VIANNAY, at the town hall, who are contesting the natural zone classification of two plots (C436 and C240). Maître VIANNAY's letter justifying this objection has been sent to the Sub-Prefect. A further meeting with the Sub-Prefect has been scheduled for Wednesday February 27 at 5:30pm in his office. The constructibility of part of the C240 cadastral parcel remains in place, and the Sub-Prefect is determined to have the Blancmesnil le Bas part of the parcel reclassified as a UB zone, but with the boundaries drawn as close as possible to the buildings. Monsieur le Maire is asking the local council to vote either to modify the PLU as requested by the government, or to abandon it and return to the RNU (Règles Nationales de l'Urbanisme).
The Municipal Council, after deliberation :
- VOTE: 4 in favour of amending the PLU
5 for a return to RNU
Quote for "Repair work on various roads".
Monsieur le Maire presents to the members of the Municipal Council the project to repair various roadways in the commune, which are in a serious state of disrepair. The pavements are in serious disrepair and have potholes. In the interests of user safety, it is urgent to undertake reinforcement work. The estimated cost of repair work on local roads is as follows:
- The construction of a turnaround at the end of the Chemin Sous les Bruyères to allow a U-turn for the fire brigade and household refuse collection services for a total amount (before tax) of €20,778.30.
- Repairs to the Chemin Sous Les Bruyères for a total of €66,644.50 (excl. VAT)
- Repairs to the Chemin des Droseras for a total of € 6,795.50 (excl. VAT)
- Repairs to the Chemin des Douaniers at a cost of €6,752.50
- Repairs to the Chemin Sous le Bois for a total of €18,262.00 (excl. VAT)
For a total before tax of 119 232.90 €.
Monsieur le Maire specifies that a call for tenders will be issued once the subsidies have been approved.
The Municipal Council, having heard the Mayor's presentation, after deliberation, unanimously :
- ACCEPTS the Mayor's proposal
- AUTHORIZES the Mayor to apply for a grant from the Department and the State
- GIVES full powers to the Mayor to sign all related documents
Seniors' meal
As usual, those aged 65 and over will be invited on March 17, 2019 to share the traditional seniors' meal.
The meal will be prepared by Restaurant de l'Ailly for a menu costing €41.50 per person.
The Municipal Council, having deliberated, unanimously :
- ACCEPTS the organization of the alumni meal on March 17, 2019
ESTRAN Agreement
By deliberation no. 2018-048 dated December 14, 2018, the Municipal Council decided not to renew the ESTRAN agreement concerning path maintenance. Monsieur le Maire explains to the members of the Municipal Council that the agreement included the paths and beach cleaning. The President of ESTRAN has drawn up a new agreement for beach cleaning. The Mayor invites the Municipal Council to vote on the three-year agreement. The commune's annual contribution is as follows:
- 2019: €2,100 - 50% i.e. €1,050 in respect of their 2018 default
- 2020 : 2150 €
- 2021 : 2200 €
The Municipal Council, having deliberated, unanimously :
- ACCEPTS l'ESTRAN's three-year agreement for beach cleaning for a period of amount of :
- 2019: €2,100 - 50% i.e. €1,050 in respect of their 2018 default
- 2020 : 2150 €
- 2021 : 2200 €
- AUTHORIZES the Mayor to sign the agreement
There being no further business, the Mayor thanked all those present and adjourned the meeting at 8:30 pm.
