Resignation :

Monsieur le Maire informs the members of the Municipal Council of a letter from Madame Sandrine Caron, Municipal Councillor, informing us that she is terminating her duties as Municipal Councillor as of October 31, 2017.

In accordance with article L. 2121-4 of the Code général des Collectivités Territoriales, the Mayor has forwarded a copy of the letter to the Sous-préfet of Dieppe.

Minutes of the meeting on the Ailly Lighthouse site enhancement project:

Monsieur le Maire informs Council members that a meeting was held on November 16 at the "Dieppe-Maritime" Agglomeration Community, attended by Mr Patrick BOULIER, President of the Agglomeration Community, Mr Régis LEYMARIE and Mrs Elise RENAULT, Conservatoire du Littoral.

The subject of this meeting was the project to upgrade the Ailly Lighthouse site.

Numerous exchanges took place:

ü The main entrance to the lighthouse will be near the site of the two former lighthouses.

ü The main lighthouse building: development of the ground floor: ticket office/shop, snack bar, museum area and lighthouse tour.

ü The janitor's house will be converted into accommodation for a janitor couple

ü The two pavilions of the old lighthouse will be minimally restored, and it will be necessary to consider securing the frets by plant fascination and/or a temporary installation via a call for artists.

ü Only access to the lighthouse would be subject to a charge, as would parking and the natural site.

ü The Conservatoire du Littoral is planning a major moorland restoration project that will restore the lighthouse's right-of-way. This work, scheduled for 2018, will give the lighthouse site the look and feel of the 1950s.

Faced with numerous regulatory issues (cliff erosion, Architecte des Bâtiments de France etc...), the Conservatoire du Littoral will provoke an inter-departmental State meeting under the aegis of Monsieur le Sous-Préfet during the 1st half of 2018: DDTM, DREAL, ABF, DIRM etc...

It is planned to convene a very broad steering committee meeting in the first half of 2018 to ratify the choice of the selected scenario.

Home cabin modification

The Mayor informs the Assembly that Mrs Charlotte Wadoux wishes to rent the reception booth to run a delicatessen.

The grocery store will offer regional products such as cider, calvados, pommeau, cider jelly, apple caramel, apple juice, Normandy cookies, books on Normandy and the D-Day landings, postcards and small souvenirs on Normandy, in order to offer products sought after by tourists.

Monsieur le Maire explains that the cabin needs to be modified to create an opening on the "road" side. The Mayor has asked for a quote for this work. Menuiserie HEBERT has submitted an estimate of €1,287.13 excluding VAT.

The Municipal Council, having heard the Mayor's presentation, after deliberation, and unanimously :

- ACCEPTS the Mayor's proposal

- ACCEPTS the quote from Menuiserie HEBERT in the amount of €1,287.13 exclusive of VAT

- AUTHORIZES the Mayor to sign all related documents.

Catering Cabin Modification

Monsieur le Maire informs the members of the Municipal Council that the dining room needs some work. Rain is seeping in through the existing shutters on the west and north sides, and they need to be removed and hermetically sealed. The HEBERT carpentry firm has submitted a quotation of €1,119.00 excluding VAT.

The Municipal Council, having heard the Mayor's presentation, after deliberation, and unanimously :

- ACCEPTS the Mayor's proposal

- ACCEPTS the quote from Menuiserie HEBERT in the amount of € 1,119.00 exclusive of VAT

- INSTRUCTS the Mayor to sign all documents relating to this operation

Rue aux Juifs" network and street lighting upgrades

Monsieur le Maire presents to the members of the Municipal Council the project prepared by the SDE76 for the "Project - Eff+EP-2015-0-76605-5739" and designated "Rue aux Juifs (version 1.2)", the estimated cost of which is €95,040.00 including VAT, and for which the commune will contribute €33,694.50 including VAT.

The Municipal Council, after deliberation, and unanimously :

- ADOPTS the above project

- INSCRIBES the capital expenditure to the 2018 primitive budget in the amount of €33,694.50 including VAT.

- ASKS the SDE76 to schedule this work for 2018

- AUTHORIZES the Mayor to sign all related documents, including the corresponding agreement to be drawn up at a later date.

Undergrounding of Electronic Communications Equipment

The Mayor explains to the members of the Municipal Council that as part of the "Rue aux Juifs" network concealment operation proposed by SDE76, the communications equipment is entirely supported by ORANGE supports. Considering that the work to be carried out is in an interest other than the interest of the occupied domain, ORANGE agrees to relocate its artery at the expense of the Sainte Marguerite Sur Mer community. ORANGE is proposing an agreement setting out the technical, administrative and financial terms and conditions for the work. The cost of the work is €7,611.00.

The Municipal Council, having deliberated, unanimously :

- ACCEPTS the Mayor's proposal

- ACCEPTS the quote of €7,611.00

- AUTHORIZES the Mayor to sign all related documents.

Departure of Mr David PETITON

Assumption of Competences for Items 4°, 11° and 12° other than GEMAPI - Modification of DIEPPE-MARITIME's Articles of Association

In accordance with article L.5216-5 of the French General Code of Territorial Authorities, the Dieppoise Region Agglomeration Community will be responsible, in place of its member communes, from January 1, 2018 for the exercise of the GEMAPI competence, enacted in article L.211-7 of the French Environment Code and corresponding to items 1°, 2°, 5° and 8° of said article:

1° Development of a river basin or part of a river basin ;
2° Maintenance and development of a watercourse, canal, lake or body of water, including access to the watercourse, canal, lake or body of water;
5° Defence against floods and the sea ;
8° Protection and restoration of sites, aquatic ecosystems, wetlands and riparian woodlands;
In the interests of administrative and hydraulic coherence, Dieppe-Maritime wishes to declare itself competent to carry out missions 4°, 11° and 12° of article L.211-7 of the Environment Code, known as non-EMPAI competencies:

4° Controlling rainwater and runoff and combating soil erosion;
11° Installation and operation of monitoring systems for water resources and aquatic environments;
12° Coordination and consultation on the management and protection of water resources and aquatic environments in a sub-basin or group of sub-basins, or in an aquifer system, corresponding to a hydrographic unit;

In accordance with article L.5211-17, transfers of powers not provided for by law are decided by joint deliberations of the deliberative body and the municipal councils, under the majority conditions required for the creation of the public inter-municipal cooperation body. The municipal council of each member commune has a period of three months from the date of notification to the mayor of the commune of the decision of the deliberative body of the public inter-municipal cooperation body, to decide on the proposed transfers. If no decision is taken within this period, the decision is deemed to be favorable.

For these reasons,

City Council,

VU the Code général des collectivités territoriales,

Having regard to the Environment Code,

HAVING REGARD TO Law n°2015-991 of August 7, 2015 on the new territorial organization of the Republic, known as the NOTRe Law,

VU the statutes of the Communauté d'Agglomération de la Région Dieppoise,

- APPROVES the modification of the statutes of the Communauté d'Agglomération de la Région Dieppoise by adding a new optional competence:

4°) Items 4°, 11° and 12° of article L.211-7 of the Environment Code, i.e. :

4° Controlling rainwater and runoff and combating soil erosion;

11° Installation and operation of monitoring systems for water resources and aquatic environments;

12° Coordination and consultation on the management and protection of water resources and aquatic environments in a sub-basin or group of sub-basins, or in an aquifer system, corresponding to a hydrographic unit.

- PRECISE that this assumption of competence by the Communauté d'Agglomération de la Région Dieppoise will be effective on January 1, 2018, provided that the conditions of article L.5211-17 of the Code Général des Collectivités Territoriales are met.

Advice allowance granted to the Treasury Accountant

VU l'article 97 de la Loi n° 82-213 du 2 mars 1982 modifiée relative aux droits et libertés des communes, des départements et des régions,

HAVING REGARD TO decree no. 82-979 of November 19, 1982 specifying the conditions for the granting of allowances by local authorities and their public establishments to employees of external State services,

VU l'arrêté interministériel du 16 novembre 1983 relatif aux conditions d'attribution de l'indemnité de conseil allouée aux comptables non centralisateurs du trésor chargés des fonctions de receveurs des communes et établissements publics locaux,

The Municipal Council, after deliberation, unanimously :

- DECIDES to grant the Public Accountant of Dieppe Municipale, Mrs. Edith LORIO, an advisory allowance in the gross amount of €374.48 for 2017.

Amending Decision No. 3

The Mayor explains to the members of the Municipal Council that, as the appropriations provided for in certain accounts of the 2017 budget are insufficient, it is necessary to make a transfer of funds:
